33% of forces mislead complainants

After raising the issue of South Yorkshire Police’s website and complaints procedure being over 2 years out of date in relation to the Nov 2012 changes (here), I thought why not see how many other police forces have got it wrong.

As of 15th Dec 2014 a staggering 33% of the 43 Police Forces either state on their public website or in their procedures for handling complaints that the complaints consent IS required for Local Resolution.

Websites

  • Only five websites correctly inform visitors that consent is not required for Local Resolution to proceed
  • Six websites incorrectly inform visitors that consent is required for Local Resolution to proceed
  • Thirty Two websites do not say whether or not consent is required.

Of the Thirty Two websites,  FOI requests on the excellent Whatdotheyknow website were consulted,

  • One FOI request still did not say either way
  • Fifteen FOI requests  correctly inform visitors that consent is not required
  • Eight FOI requests indicated that the force use the IPCC Statutory Guidance
  • Eight FOI requests contained procedures or forms that incorrectly stated that consent is required for Local Resolution.
A total of 14 of the 43, some 33%, police forces still do not appear to understand the changes to the complaints legislation that came into effect in Nov 2012.
